Possible Trouble Ahead - Thanks For Your Help
 
CapitolBelow is a message from NCISS Lobbyist Larry Sabbath followed by the list of generous donors to the NCISS Legislative Fund who fund Larry's work.
 
As everyone knows, when a session is over, either in Congress or State Legislatures, any bills which have not passed, automatically die and must be re-introduced next year.  Sabbath's message below outlines possible problems for our professions in the "lame duck" session after the elections but before adjournment.  Although Congress is now home trying to get reelected, there is still work to be done In Washington.  Yesterday, for example, the EEOC held a hearing about banning the use of credit reports in pre-employment investigations.
  
Here are Sabbath's thoughts regarding the post election pre-adjournment possibilities: 

"Congress will be returning to Washington on November 15.  While most interest will be focused on expected changes following the election, there is significant unfinished business that must be completed before the 110th Congress concludes.  Tax policy and appropriation bills head the issues that must be addressed next month, but there are several pending bills with a direct impact on NCISS members that could receive votes. These include data breach legislation (HR 2218/S3742) that mischaracterizes investigators as information brokers and "anti-spoofing" bills(HR 1258/S30).  Also pending is the ''Federal Protective Service Improvement and Accountability Act of 2010'' (HR 6122) which is the first step toward replacing private security officers with federal employees.  The House may also consider legislation to ban employer access to credit reports (HR 3149).
 
"The danger with "lame duck" sessions of Congress is that many members of congress will not be returning in January and can vote without any political risk.  The Wall Street Journal reported yesterday that Senator Tom Harkin (D-IA) may bring the union backed "card check" bill to a vote in the Senate.  That bill would end the right of employers to require a secret ballot election during union organizing campaigns. 
 
"Virtually all the prognosticators are predicting substantial Republican gains in Congress on November 2.  It is now conventional wisdom that the Republicans are likely to take over the House of Representatives and pick up just a few seats short of a majority in the Senate.  If the Republicans fall just two seats short of a Senate takeover, it could get very interesting.  Election analyst Charlie Cook said this week that there is speculation that conservative Democrat Ben Nelson of Nebraska and Senator Joe Lieberman (Ind-CT) could then be persuaded to jump to the Republican side."
