Congressmen Would Ban Pretexting -- NCISS

At a hearing on June 15, 2011 for a suggested breach bill authored by Rep.
Mary Bono Mack, (R-CA) before the subcommittee of the Energy and Commerce
Committee she chairs, Rep. Charles Gonzalez (D-TX) suggested that language
be added to ban pretexting. Although Bono Mack’s bill is narrowly drawn to
address data breach issues, Rep. Henry Waxman, (D-CA) said it should be
broadened to more tightly regulate information brokers.
Observers said that it appeared the Democrats were hoping to outlaw “rogue
information brokers” who in past years sold personal bank and telephone
records. These observers wondered if the Congressmen were aware that
subsequent to those years, Gramm Leach Bliley has made it unlawful to
pretext financial organizations, or that the Telephone Records and Privacy
Protection Act, passed in 2007 after the Hewlett Packard scandal, does the
same for phone records.
There is suddenly a flood of privacy related legislation with three new
bills arriving just yesterday.
It appears that Senator Dianne Feinstein has retreaded her bill including
SSN issues. Several legislators seem to be using text which, as written, is
unfavorable to our profession or ambiguous as to how an information broker
is defined
