Letter To EEOC Urges Input From Background
Check Providers & Users
The Equal Employment Opportunity Commission (EEOC) is planning to make
changes to guidance on the employer use of background checks.
Earlier this year, I submitted an official "public comments" to the EEOC on
behalf of NCISS regarding the proposed limitations on credit checks. Our
Legislative Advocate Larry Sabbath also met with EEOC officials recently to
explain why our continued access to both criminal and credit histories are
critical to maintaining a safe workplace.
Today, Senator Mike Enzi (R-WY), the Ranking Republican on the Senate
Committee on Health, Education, Labor and Pensions, wrote the attached
letter to the Chair of the Equal Employment Opportunity Commission (EEOC).
Senator Enzi urged the EEOC to use an open process that allows input by
outside parties prior to making any changes to its guidelines on the use of
background checks. The EEOC is expected to issue new guidelines on the use
of the histories early next year.
NCISS is working with two business coalitions to help maintain our access to
these vital reports. The Legislative Committee and I will continue to keep
