Legislative Alert - Lawsuit
With Regard to Arrest Records
Colleagues:
Attached is an article from the Washington Post that discusses a
class action lawsuit alleging that the US Census Bureau violated
discrimination laws when it denied employment on the basis of
arrest records.
The issue could impact consideration of pending federal
legislation (HR5300) which includes a provision excluding the
reporting of unresolved arrest records from the FBI database
after one year. NCISS has opposed that provision because it
would make criminal records less accurate.
If arrest records were dropped, state officials ordering
criminal histories while considering applications for weapons or
professional licenses would not be aware of pending criminal
charges.
