Credit Check, Stalking Bills Introduced
Congressman Steve Cohen, (D-TN) has reintroduced his bill to ban employer
access to credit reports, the " Equal Employment for All Act", HR 321. The
legislation denies access to credit information in most instances, even with
employee consent. Last Congress the House Financial Services Committee held
two hearings on the issue but the bill never came to a vote. It will be
interesting to see if the legislation makes any progress this year with a
Republican controlled Congress.
The "Stalkers Act of 2011" has also been introduced, by Rep. Loretta Sanchez
(D-CA). The bill would prohibit surveillance that
''(1) causes or attempts to cause bodily injury or serious emotional
distress to a person other than the person engaging in the conduct; or
''(2) engages in conduct that would be reasonably expected to cause the
other person serious emotional distress."
The "emotional distress" language could prove troublesome and will be
reviewed by the legislative committee.
This week most of the House Committees are organizing subcommittees and
electing subcommittee chairs. We can anticipate a rapid increase in
congressional activity from now on. Next week President Obama will lay out
his agenda during the "State of the Union" address. We will keep you
