Another Data Breach Bill
Introduced in Washington, DC
Colleagues,
Leaders of the Senate Committee on Commerce, Science and
Transportation
introduced a major data breach bill Thursday. The Data Security
and Breach
Notification Act of 2010 (S 3742) was introduced by Senator Mark
Pryor
(D-AR), Chairman of the Subcommittee on Consumer Protection,
Product Safety,
and Insurance and full committee chair Jay Rockefeller (D-WV).
The bill
would require entities which possess personal data to establish
procedures
to protect it, notify consumers in the event of a breach and
provide credit
monitoring for two years after a breach is discovered. The NCISS
Legislative Committee will review provisions of the legislation
to ascertain
the impact on NCISS members.
S 3742 is one of many privacy "data breach" bills under
consideration in
Congress. Earlier this year the House passed HR 2221, the "Data
Accountability and Trust Act". The Senate Judiciary Committee
has also
passed S 1490, the "Personal Data Privacy and Security Act of
2009' and S
139, the "Data Breach Notification Act". The support of Chairman
Rockefeller indicates that the Committee may act on the bill
when the Senate
returns to work after the election. However, it is unclear at
this time how
these bills would be considered on the Senate floor. There has
been some
discussion about merging a "data breach" bill with pending
legislation
regarding cyber security. Senator Rockefeller has his own
legislation on
that issue, and Senator Joe Lieberman (I-CT), Chairman of the
Committee on
Homeland Security and Governmental Affairs has his own version.
In previous
years, jurisdictional disputes among the various committees have
helped
prevent passage of privacy legislation.

Senate Majority Leader Harry Reid (D-NV) has announced that the
Senate will
return after the election for a "lame duck" session, starting
the week of
November 15. Because the election is likely to weaken Democratic
control in
Congress, there may be major effort to enact legislation before
new members
of Congress are sworn in come January. The timing of this year's
"Hit the
Hill" is fortuitous, as it will provide an opportunity to
provide
information about security and investigative issues immediately
before what
should prove a very active legislative period right before and
right after
the election.
